In April 2024, the Department of Labor published a final rule implementing a new salary level for executive, administrative, and professional exempt employees, a new salary level test for highly compensated employees, and a mechanism for automatic, future updates.  In November 2024, an Eastern District of Texas ruling vacated the DOL’s 2024 final rule.  Join us in January for an update on the 2024 final rule, the effect of the November 2024 court ruling, a refresher on the history of the salary level test, an explanation of the current status of the salary level test, and a discussion of what’s likely to come in 2025. 

 

Bio

Allison L. Davis is a member of Brown & Fortunato’s Labor and Employment law team, where she is a shareholder and director. She is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization. She practices primarily in employment litigation, employment counseling, and commercial litigation. Allison represents clients in a wide range of litigation and pre-litigation matters, including employment discrimination, non-competition disputes, wage and hour issues, and business disputes. 

Allison frequently advises employers on exemption, classification, and pay issues and often drafts and advises employers on the enforceability of non-competition, severance, and confidentiality agreements. In addition, Allison routinely handles internal investigations as well as audits and investigations by the Equal Employment Opportunity Commission, Department of Labor, and Texas Workforce Commission. Allison also drafts employee handbook policies and procedures and advises employers on proper hiring, disciplinary, and termination practices. 

Allison attended Austin College in Sherman, Texas, where she earned a B.A. in Communication Arts and a minor in French. In 2008, she graduated summa cum laude from Texas Tech University School of Law and was inducted into the Order of the Coif.

Allison and her husband, Nate, have two sons, Graham and Weston. Allison enjoys cooking, gardening with her husband, reading, and spending time with her family and friends.
